Respected Joint Secretary and the Members of the JPC,

We would like to bring some of the issues identified in this Bill, to your notice.

1. The Amendments proposed through the WAQF bill 2024 are unconstitutional and deprive the basic rights of the Indian Muslim community with respect to WAQF.
2. This bill is restricting the powers of the WAQF tribunal and giving unequal rights to the district administration, please note all the WAQF boards consist of officers (including the CEO, etc.,) who also passed through UPSC exams., are we not believing our own officers only because they are Muslims? Is this not discriminatory and unconstitutional?
3. The Bill has provisions to object to the registration of waqf properties, this will give room for anti-social elements to snatch the waqf properties
4. The overriding powers of WAQF (Section 108 A) have been revoked, this will ease the job of anti-social elements to illegally use the waqf properties.
5. The share given from the Waqf-owned institutions to Waqf administration is reduced from 7 % to 5 %, This reduction in funds will further weaken the Waqf boards which are already struggling to run their operations.
6. Section 108 has been repealed due to which the evacuation of encroachers becoming impossible for the waqf board, unlike the District administration waqf board’s primary goal is to protect the waqf property which will be defeated here.

Considering all this we would urge the JPC to recommend to scrap this bill proposed. Which will save the properties of the Muslim community and its basic human rights.
